GLOSSARY
 

ADMINISTRATOR
 
A person appointed by legal process to administer the estate of the deceased where there is no valid Will.
 
BRIEF

The written instruction which a Solicitor sends to a Barrister regarding the representation of a client in legal proceedings.
 
CAUTION
 
Can mean either the warning given by the police to a person when arrested or a formal warning given to someone who admits an offence in a situation where the police do not intend to prosecute.
 
CLAIM (formerly writ)
 
The official notice of a person's claim against another
 
CONVEYANCE
 
The name given to both the transfer of ownership in property or land and the document which executes the transfer.
 
COUNSEL
 
Another name for Barrister.
 
CROWN PROSECUTION SERVICE
 
A national service which works with police forces by advising them on offences and conducting criminal proceedings on their behalf.
 
DEFAMATION
 
The publishing of a statement which may lower a person in society's estimation.
 
EXCHANGE OF CONTRACTS
 
The point in a conveyancing matter where both parties become legally bound to buy/or sell.
 
EXECUTOR
 
A person appointed by a Will to administer the estate of the deceased and carry out the provisions of the Will.
 
POWER OF ATTORNEY
 
Document authorising one person to act on behalf of another in the absence of that other.
 
PROBATE
 
Essentially, this is the document issued as official evidence of the authority of the Executor to administer the property of the deceased and carry out the provisions of the Will.
 
QUEEN'S COUNSEL
 
A senior Barrister who is allowed to appear in cases for or against the Crown and takes precedence over the other Barristers in Court.
 
SLANDER
 
Spoken words which may lower a person in society's estimation.
 
STATEMENTS OF CASE (formerly pleadings)
 
The written statements in a civil action which state the factual allegations which the party pleading is claiming relief upon.
 
TRUSTEE
 
A person to whom the legal ownership in property is given so that they can administer the said property for the benefit of another.
