Matrimonial/Relationship Breakdown

Sadly, it is a fact that many more marriages end in divorce or separation. Relationships also break down where partners are not married.

Same sex couples, whether or not in a formal Civil Partnership, face similar difficulties when a relationship comes to an end.

When this happens, as well as the emotional trauma to be overcome, there are practical considerations that need to be addressed.

A family’s financial situation is of vital importance to ensure the appropriate division of both parties assets. We can assist clients through this difficult period of their lives with a view to seeking as much financial and practical stability as possible.

We can also offer advice on all matters concerning children to ensure the simplest and least painful transition. Courts favour parties endeavouring to rreach agreement between themselves and to this end we actively promote referrals to Mediation where appropriate.

We can make arrangements for your legal costs to be met in a manageable way as well as discussing the availability of Legal Aid.

FIXED FEE DIVORCE/ CIVIL PARTNERSHIP DISSOLUTION

In these difficult economic times we have recognised that many of our clients can no longer afford the outlay of a High Street Solicitor’s hourly rate. We therefore believe that it is important to be able to offer an expert service at a competitive rate by way of a fixed fee for uncontested Divorce Proceedings.

We can offer this service for a fee of £400 plus VAT and Court Fees (Court fees are currently £340 for the petition fee and £45 for Decree Absolute) to include all work required to conclude uncontested Divorce Proceedings or Dissolution of Civil Partnership Proceedings. We will meet you initially and prepare everything required from your Petition for Divorce to the completion of all documents required to ensure that the Court issues a Decree Absolute to conclude your divorce.

If you are the Respondent (other party) in Divorce/ Civil Dissolution Proceedings, we can offer a fixed fee of £195 plus VAT for uncontested matters up to Decree Absolute.

The service does not include advice and proceedings concerning finances and children matters or any additional work that may be invoilved should the Petition become defended or need to be amended in any way once issued by the Court.

Each party’s financial claim against the spouse does not end when Decree Absolute is pronounced. This should always be dealt with by a Clean Break Consent Order where possible.

We will be happy to discuss different levels of service it might suit you to receive in order to deal with financial matters following on from divorce (known as Ancillary Relief Proceedings), or where there are Court Proceedings concerning your chidlren following the divorce or seperation.
